Did the Endowment Forest actually transfer to the Board?

The Crown repeatedly proposed and budgeted for transfer of the Waitangi Endowment Forest. The documentary trail is unusually useful because later records repeatedly show that the transfer was still awaiting legal and implementation steps. 1. 2011 — Government announced an investigation, not a transfer

A January 2011 ministerial announcement described the approximately 550-hectare Waitangi Endowment Forest as vested in the Crown and said the Crown would investigate with the Board whether ownership should be transferred. The language is prospective. [Beehive 2011 ↗]

2. 2012 — accounting recognised an intended transaction

Budget material later carried a $3.371 million amount associated with the forestry assets and described a write-off through transfer to the Board. On its own that wording could look like completion. Later appropriations are decisive: they repeatedly say the transaction remained pending legislation. [Treasury 2012 ↗] [later deferral ↗]

3. 2014–2022 — the Crown repeatedly carried the disposal forward

4. 2024 — the issue was still active in ministerial advice

5. 2025 — the strongest current implementation evidence says it was still delayed

A Department of Conservation briefing released under OIA in April 2025 states that the majority of a locked-in disposal transfer related to the Waitangi Endowment Forest land and says the transaction had been delayed while awaiting royal assent on enabling legislation, transfer of forestry and land to the Board, and agreements with third parties. 6. 2026 — current operational records still distinguish the Endowment Forest

In June 2026 the Far North District Council described the Waitangi Endowment Forest as created under the 1932–33 Act and managed by the Department of Conservation on behalf of the Waitangi National Trust Board. DOC’s current public-conservation-land data also retains a specific Waitangi Endowment Forest statutory classification. [FNDC 2026 ↗] [DOC 2025 ↗]

Those records are consistent with an operational relationship between the Crown/DOC and the Board. They are not, by themselves, a certified title search. But they give no basis to presume that the entire Endowment was silently absorbed into the Board’s 506-hectare National Trust estate. [FNDC 2026 ↗] [DOC 2025 ↗]

Finding

The transfer was proposed, funded and repeatedly deferred. The public evidence located so far does not close the title arrow from Crown-held Waitangi Endowment → Waitangi National Trust Board. [2011 proposal ↗] [Treasury deferral ↗] [DOC 2025 ↗]

To mark that arrow “vested”, the ledger still requires the enabling legislation or other lawful transfer authority, the executed transfer/vesting instrument, and the resulting record of title or equivalent LINZ evidence. [DOC 2025 implementation steps ↗]
