What is “Māori” in current New Zealand law?
Modern New Zealand law separates citizenship from Māori descent. Being Māori is not, by itself, a present-day British-subject nationality status.
The modern legal position is structurally different from 1865.
The Citizenship Act 1977, in force from 1 January 1978, establishes the law of New Zealand citizenship. It does not define New Zealand citizenship by Māori ethnicity. Citizenship is acquired through the statutory routes of birth, descent, grant and associated transitional rules.
Other statutes use “Māori” for different legal purposes. Te Ture Whenua Māori Act 1993 defines Māori as a person of the Māori race of New Zealand and includes a descendant of such a person. The Electoral Act 1993 uses materially the same descent-based definition for its electoral scheme.
The old imperial vocabulary also changed. The United Kingdom's British Nationality Act 1981 reorganised British nationality and, for post-commencement instruments, distinguishes “British subject” from the broader concept of Commonwealth citizenship. The historical expression “British subject” therefore cannot safely be lifted out of an 1865 Act and applied unchanged to Māori in 2026.
What present NZ law supports
A person may be Māori because of descent and may separately be a New Zealand citizen under the Citizenship Act. Those are distinct legal classifications.
What present law does not support
There is no general rule that a person is presently a British subject simply because that person is Māori.
The historical question remains important, but it must be expressed in the past tense: when, why and with what consequences did colonial New Zealand law classify Māori as natural-born British subjects?
